John Calitz and/or any representative of BearZA.co.za will be hereby referred to as “BearZA”.
Clients making use of BearZA’s services will hereby be referred to as “client”.
1. Consultation
This is a service where BearZA will discuss various aspects of moving over from a Windows/Mac Operating system to that of one that is based on the FOSS Linux Kernel. BearZA will, based on client input, make recommendations to the client on what software to install, such as, but not limited to, Linux Distrobution, desktop environment, software and drivers.
Consultations are done verbally and as a best effort. No guarantee is made on the outcomes of the consultations.
Recommendations are made based on client input, no liability will be held by BearZA based on the client’s implementation of any recommendations made by BearZA.
The client agrees to be held fully liable for any data loss, loss of operational time or any other losses when implementing any recommendations made by BearZA. That is, BearZA will hold no liability for the client’s actions during/post consultation.
Consultation fees are non-refundable.
Follow up consultations will carry a 60% fee of the initial consultation fee.
Consultations are to be no longer in duration than one hour, following which a 50% fee will be charged for every additional hour or part thereof.
2. Installation
Should the client want BearZA to implement recommendations discussed during the consultation, BearZA will do so should they be available and the hardware is in good, operable condition. BearZA reserves the right to make use of a third party where the need arises. Hardware cleaning, will carry an additional charge.
The client will be responsible to ensure that their required data, passwords, accounts, etc. are backed up to a reliable location before BearZA attemps to install or modify any Operating Systems or Software on the client’s hardware, such as Desktop PC or Laptop.
The client acknowledges that old hardware could potentially be near to failure and will not hold BearZA liable for damages should this hardware critically fail during the course of installation.
The client acknowledges that much newer or niche hardware may require some work-arounds or additional driver packages, and in some cases not be compatible with the new operating system. This will be researched and testsed before an installation is attempted, but it can not always be 100% certain.
BearZA will accept liability for physical damage to hardware should it have been damaged while in their possession by means of negligence. Records will be kept in the form of photographs and/or video upon recieving, work done, and return of the hardware. BearZA will not accept liability for damages in the case of faulty, old or dirty/unmaintained hardware.
Should the client request BearZA to clean/service the hardware, such as dust removal, thermal paste and cable management, the client absolves BearZA of any liability for damages.
BearZA will not provide hardware upgrades or replacements, but can recommend other service providers to the client should they need it.
Installation will carry an aditional fee, over and above the consultation fee.
3. General & Payment
BearZA reserves the right to change pricing, and update this agreement at any point. Clients will be informed of any changes.
Payment will be made in either Cash, PayShap or Instant EFT no later than 24 Hours after the consultation and/or installation has been completed. Failing which an additional 10% fee will be charged. Hardware will not be released before payment has cleared into BearZA’s account.
Should payment not be made within four weeks of the 24 Hour period, BearZA reserves the right to recuperate costs by selling of the client’s hardware. The difference, minus 10% of the amount owed, will be paid back to the client.
BearZA does not have control over the various softwares’ development and will thus not be held liable for losses resulting in changes to software over time.
BearZA will provide support for the new operating system and software where possible & reasonable, free of charge for the first 3 queries within 6 months.
